what software would be best to create guitar music?

I am thinking about creating a guitar hero/Frets on fire like game. I was wondering if I have to create my own songs so I don’t have to worry about copyright issues. If so what software would you guys suggest? Preferably would like open source. Would royalty free or public domain music be good for this type of game?

how awesome would it be if you actually picked up a real guitar?
